Terms of Use – Pocket Casts Paid Services

These terms for paid-services supplement Pocket Casts’ Terms of Use found here https://support.pocketcasts.com/article/general-terms-of-use (the “Terms”). All capitalized words not defined herein shall have the meaning set forth in the Terms.

1. Your Membership Rights and Obligations
1.1 By paying the fixed subscription fee you will become a member of the Application. As a paying member you will gain exclusive access to various features on the Application. This will include a feature enabling you to upload files onto the platform in accordance with the Terms. The files you upload are not to be shared with other Pocket Casts members.

1.2 You shall not add, store or contribute any content (“User Content”) to the Application:
(i) unless you hold all necessary rights, licenses and consents to do so and have fully complied with any such third-party licenses relating to User Content (including paying all royalties, fees and any other monies required to be paid in connection with such User Content);
(ii) that would cause you or us to breach any law, regulation, rule, code or other legal obligation;
(iii) that is or could reasonably considered in our sole discretion: (1) to be obscene, defamatory, disparaging, indecent, offensive, threatening or to incite racial hatred, discriminatory, blasphemous, in breach of confidence or in breach of privacy or otherwise objectionable; (2) that would demean, criticize, place in a negative or false light, harm or negatively affect the reputation of Pocket Casts, the Application or its associated features; (3) that infringes is likely to infringe the intellectual property or other proprietary rights of any person, or (4) is likely to subject us or our affiliates to any monetary and/or legal obligations.

1.3 You are solely responsible for maintaining the confidentiality of the password associated with your account and for restricting access to your password and to your computer while using the Application. You accept responsibility for all activities that occur under your account or from your devices. You accept all risks of unauthorized access to the user data and any other information you provide to us.

2. Accounts and Paid Subscription Packages

2.1 We may make certain products and/or services available to users of the Application in consideration of a subscription fee or other fees (“Premium Services”), including the ability to purchase products and services from within the Application (“In-App Products”). If you choose to use Premium Services or make purchase of In-App Products via a third-party application store (like iTunes or Google Play), then such third-party application store will charge you for any such applicable fees or charges (including any applicable taxes), according to their terms and conditions attributable to such purchase.

2.2 If you purchase an auto-recurring periodic subscription through an in-app purchase, you will continue to be billed for the subscription until you cancel. If you do not wish your subscription to renew automatically, or if you want to change or terminate your subscription, you will need to log in to your account and follow instructions to cancel your subscription, even if you have otherwise deleted your account with us or if you have deleted the Application from your device. Deleting your member account or deleting the Application from your device does not cancel your subscription. You must cancel your Account as set forth in these Terms.

2.3 You retain the right to cancel your subscription at any time which must be done via your Apple or Google account or the via the Pocket Casts website or desktop application (however you originally subscribed). Upon cancellation, you will continue to be subscribed to the Application until the conclusion of the relevant billing cycle, at which point your subscription and access to the Premium Services will cease.

2.4 If you cancel your subscription, following the subscription expiration date, Pocket Casts reserves the right delete all files being stored on the platform.

3. Billing Cycle and Payment

3.1 The membership fee for the Premium Services, the purchase price of In-App Products, and any other charges you may incur in connection with your use of the service, such as sales tax, VAT, and any other transaction fees, will be charged to you via your Apple or Google account or via the third-party payment gateway accessible through our website or desktop application (however you choose to subscribe). Our third-party order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all of these orders.

3.2 The length of your billing cycle will depend on the subscription type you select at sign-up for the subscription. Subscription fees will be payable on either an annual or per month basis.

3.3 In certain circumstances the payment date may change, for example, if your chosen method of payment has not successfully settled.

3.4 Payments will either be to Pocket Casts directly or to a third-party payment processor. Your membership will be terminated in the event of non-payment.

3.5 If a member exercises its cancellation right, Pocket Casts or its billing agents will not charge further subscription fees following the date of cancellation. Members will retain access to Premium Services until the billing cycle concludes. The expiration date will be fixed in-application at the time of subscription.

3.6 All subscription fees are non-refundable.

3.7 Pocket Casts may change your subscription fee from time to time, however, any price changes will apply to subsequent billing cycles only.

3.8 Pocket Casts may, from time to time, offer new members a “free trial” period where subscription fees will be waived for a period of time.

4. Intellectual Property Rights

Content uploaded by you will remain the property of the contributor or creator. Pocket Casts will not, without user consent, publish the contributed content. However, by posting any User Content onto the Application or its network, you grant us a perpetual, non-exclusive, fully-paid, royalty-free, sublicensable and worldwide right and license to host, cache and copy the User Content to and from various servers and our associated networks and to play same to you upon your request. You represent that all User Content is stored for your personal, non-commercial use and represent that you have all rights to store, retrieve and listen to any User Content and that you have all necessary rights to grant the licenses and consents with respect to your User Content and for the rights you grant under these Terms.

1. License to use Application; Your Rights and Obligations

1.1 Subject to your compliance with these Terms, Pocket Casts grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferrable license to access and use the Application and any of its content, information and related materials on your personal electronic device, solely for your personal, non-commercial use.

1.2 You understand that all information, data, text, software, sound, photographs, graphics, video, messages, tags, or other materials available in connection with the Application (“Content”) are the sole responsibility of the person from whom such Content originated. We do not control, monitor, endorse, sponsor or approve any Content and do not guarantee the accuracy, integrity, or quality of such Content. You understand that by using the Application, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will we be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content made available on the Application.

1.3 You acknowledge and agree that (i) we retain complete editorial control over the Application and may alter, amend or cease the operation of the Application at any time in our sole discretion without notice to you; and (ii) the Application may be unavailable from time to time (including for maintenance purposes).

1.4 You may not:
(i) remove any copyright, trademark or other proprietary rights notices from the Application or any Content;
(ii) edit, reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, public perform, stream, broadcast or otherwise exploit the content on the Application unless expressly permitted in writing by Pocket Casts;
(iii) decompile, reverse-engineer or disassemble any features of the Application; or
(iv) utilize any programs or scripts for the purpose of scraping, indexing, measuring or otherwise data mining any parts of the Application or otherwise hindering the functionality of any part of the Application.

2. Intellectual Property Rights

2.1 The Application and the Content are the property of Pocket Casts and its licensors, and are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in these Terms constitutes a transfer of any intellectual property rights. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

2.2 If you provide us any feedback, ideas and suggestions about the Application or Content (“Feedback”), you assign to us, your entire right, title and interest (including, without limitation, all patent rights, design rights, copyrights and trade secrets) in the Feedback. To the extent such rights cannot be assigned, you hereby waive such rights as to Pocket Casts, its affiliates and its and their customers and business partners.

3. Disclaimer of Warranties; Limitation of Liability; Consequential Damages and Indemnity

3.1 The Content and Application are provided to you “as is” and without warranty. Pocket Casts and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors (collectively, the “Pocket Casts Parties”) hereby disclaim all warranties with regard to same, including, without limitation, (a) all implied warranties and conditions of merchantability, fitness for a particular purpose, performance, accuracy, reliability, availability, compatibility, title and noninfringement; (b) any errors or defects will be corrected; (c) the Application is free of viruses or other harmful components; or (d) the results of using the Application will meet your requirements. Your use of the Application and any Content (including any third-party service or advertisement available through the Application) is at your own discretion and risk and you are solely responsible for any damage to your computer system or other device, or your loss of data , profits or revenue (or any other punitive, incidental, special or consequential damage) that directly or indirectly results from such use.

3.2 To the full extent permitted by applicable law, you acknowledge and agree that the aggregate liability of the Pocket Casts Parties collectively for claims arising under the Terms or otherwise howsoever arising shall be limited ten dollars (USD$10.00). This limitation of liability is cumulative and not per-incident (i.e., the existence of two or more claims will not enlarge this limit).

3.3 You expressly agree to release the Pocket Casts Parties from any and all liability connected with your activities, and promise not to sue the Pocket Casts Parties for any claims, actions, injuries, damages, or losses associated with your activities, whether based on contract, tort, strict liability, or otherwise, even if Pocket Casts has been advised of the possibility of damages. Because some states/jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.

3.4 You agree to indemnify, defend and hold harmless all Pocket Casts Parties, from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Application or your violation of the Terms.

4. Termination

4.1 These terms terminate automatically if, for any reason, we cease to operate the Application.

4.2 Pocket Casts retains the right to terminate these Terms immediately if you have breached these Terms in any way.

5. Arbitration

Except as set forth elsewhere in these Terms to the contrary, any dispute, controversy or claim relating to these Terms or the Application shall be resolved through a confidential, final, binding, and non-appealable arbitration under the rules of the American Arbitration Association (the “AAA”) in effect from time to time (with right to engage in pre-hearing discovery in connection with such arbitration proceedings if approved by the arbitrator). The place of arbitration shall be in New York County, New York. A single arbitrator shall be appointed by agreement between the parties or, failing such agreement, by the AAA. The parties hereto agree that each party will only be permitted to bring claims against the other party only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Unless both parties agree in writing otherwise, the arbitrator may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding. In addition, the arbitrator may award relief (including monetary, injunctive, and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s). Any relief awarded cannot affect other contributors or users. The arbitrator may grant any remedy that he or she deems just and equitable within the scope of these Terms. The award of the arbitrator shall be final and binding and judgment thereon may be entered in any court having jurisdiction. The costs and expenses (including reasonable attorney’s fees) of the prevailing party shall be borne and paid by the part(ies) that the arbitrator determines are the non-prevailing part(ies). Notwithstanding the foregoing, either party may seek interim or temporary injunctive relief in any court of appropriate jurisdiction with respect to any alleged breach of such party’s intellectual property or proprietary rights. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that an arbitration can proceed on a class basis, then this arbitration provision shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

6. Third Party Sites

The Application may contain links to websites operated by third parties (“Third Party Sites”). For example, you can access our various social media pages through links on the Application, and you may be able to share information with Third Party Sites through links on the Application; however, we do not own or operate the Third Party Sites, and we have not reviewed, and cannot review, all of the material, including goods or services, made available through Third Party Sites. We do not represent, warrant or imply that we endorse any Third Party Sites or any materials, opinions, goods or services available on them. Third party materials accessed through or used by means of the Third Party Sites (i) may also be protected by copyright and other intellectual property laws and (ii) may also be subject to their own terms of use and privacy policy). You should review the Third Party Site’s terms and conditions and privacy policy, and inform yourself of the regulations, policies and practices of these Third Party Sites.

7. Digital Millennium Copyright Act

We follow the notice and take down provisions of the Digital Millennium Copyright Act (the “DMCA”). In addition, we may terminate the account and access rights of any repeat infringer in appropriate circumstances. If you are a copyright owner or the legal agent of a copyright owner, and you believe that any Content infringes upon your copyrights, you may submit a notification pursuant to our DMCA Policy by sending an email to dmca@pocketcasts.com with a subject line beginning “DMCA Notice” that contains the following information:
(i) A physical or electronic signature of a person authorized to act on behalf of the owner or an agent of an exclusive right that is allegedly infringed;
(ii) Identification of the copyright claimed to have been infringed;
(iii) Identification of the material that is claimed to be infringing, and where it is located in the App or Service, as applicable;
(iv) Information reasonably sufficient to permit us to contact you;
(v) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

We respect the intellectual property rights of others and will respond to clear notices of alleged infringement. You acknowledge that if you fail to comply with all of the requirements of this section, your notice may not be valid.

8. Miscellaneous

8.1 Severability. In the event that one or more terms of these Terms becomes or is declared to be illegal or otherwise unenforceable by any court of competent jurisdiction, each such term shall be deemed deleted from these Terms in such jurisdiction. All remaining terms of these Terms shall remain in full force and effect and such deletion shall not apply to the Terms in other jurisdictions.

8.2 Applicable Law. These Terms and the Application and any action related thereto shall be governed, controlled, interpreted and defined by and under the laws of the State of New York, without regard to the conflicts of laws provisions thereof. The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms. This Application is controlled by Pocket Casts from within the United States of America. We make no representation that the Content or the Application are appropriate or available for use in other locations, and access to them from territories where their content or use is illegal is prohibited. Those who choose to access the Application from locations outside of the United States do so on their own initiative and are responsible for compliance with applicable local laws. You may not use or export the Content or the Application in violation of U.S. export laws and regulations.

8.3 The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Our notice to you via email, regular mail, or notices or links on the Application shall constitute acceptable notice to you under these Terms.

8.4 These Terms constitutes the entire agreement between us and unless specifically stated in these Terms, no other representation, document or statement shall be considered part of these Terms.

The content and services available in connection with the site https://play.pocketcasts.com and related mobile application, and their related systems or networks (the “Application”) are made available to you ( “you” or “your”, as the context requires) by Podcast Media LLC (“Pocket Casts”, “we”, “our” and “us”, as the context requires) subject to these Terms of Use and those terms and conditions set forth in the Privacy Policy https://support.pocketcasts.com/article/privacy-policy (the “Terms”).  By using the Application, you agree to follow and be bound by the Terms, which may be updated by us from time to time without notice to you.  You can review the most current version of the Terms at any time here https://support.pocketcasts.com/article/terms-of-use-overview.  We and third-party providers may make improvements and/or changes in any part of the Application at any time without notice.  The Application is offered and available only to individuals who are 18 years or older, or 13 years or older with parental consent, or the applicable age of majority in your country.  By using or accessing the Application, you represent and warrant that you meet these requirements.

Plays the episode you were last playing in any of our apps (iOS, Android, Desktop).

Similar to the one above, but it will play the newest unplayed episode. So if you’ve already played the latest one, but not the one that came before it, it will play that instead.

“Alexa, ask Pocket Casts what’s playing”
Will tell you what’s currently playing, or if nothing is playing, tell you what you have queued in your Up Next list through other devices.

“Alexa, ask Pocket Casts what’s up next”
If you have more than one episode queued up, this will tell you about the next one.

“Alexa, ask Pocket Casts about the featured podcast”
Will tell you a bit about the podcast we’re currently featuring and offer to play it for you.

“Alexa, ask Pocket Casts for some recommendations”
Will offer you up to 3 recommendations based on your playback history. A good way to find something to listen to that’s tailored to you.

“Alexa, tell Pocket Casts to surprise me”
A bit more of a roll of the dice, we’ll randomly pick an episode from your subscriptions without trying to be too smart about it. A fun way to find new things to listen to.

You can say this whenever you’re interacting with the Pocket Casts skill and you’re not quite sure what to do next, or what other things you can do.

Playback Commands:

“Alexa, Pause”
“Alexa, Resume”
“Alexa, Stop”
“Alexa, Play”
“Alexa, next episode”

All do what you’d expect them to allowing you to easily play, pause and skip episodes.

Note:

The Skill is currently only available for the following English locales: US, UK, Australia and Canada.


Archiving Episodes

When you want to remove episodes from an episode filter or not show them on a podcast’s page, you can choose to archive them. Archiving will also delete the episode’s download file. You can find more information on Archiving in this blog post.

To archive episodes manually

  • Swipe right to left over an episode in an episode list or filter
  • Or tap on an episode, and tap the archive button
  • Or long press on an episode in a list and tap the archive button – you can also tap other episodes in the list to select those for archiving as well
  • Or long press on an episode in a list, then long press again, choose Select all above or Select all below, then tap the archive button
  • Or long press on an episode in a list, then tap the vertical ellipsis, tap Select all, tap any episodes you don’t wish to archive to deselect them, then tap the archive button. If you wish to deselect all to start again, tap the vertical ellipsis and tap Select none to clear your selections
  • Or on a podcast’s page, tap the vertical ellipsis and tap Archive All to archive all episodes of that podcast
  • Or on a podcast’s page, tap the vertical ellipsis and tap Archive All Played to archive all completely played episodes. This option will only appear if you have completely played episodes in the list to archive

On the full player you can add archiving via the customizable toolbar to be included in the four most used actions. Otherwise you can find the archive option via the vertical ellipsis.

To auto archive episodes for all podcast subscriptions

  1. Tap Profile
  2. Tap the Settings cog
  3. Tap Auto Archive
  • Played Episodes: choose whether episodes should be archived as soon as they are finished playing, at some point later, or never
  • Inactive Episodes: episodes are considered inactive when you haven’t played, downloaded or unarchived within a given period of time
  • Include Starred Episodes: if toggled on starred episodes will be auto archived, if toggled off starred episodes will not be auto archived

To auto archive episodes per podcast

  1. Go to that podcast’s page
  2. Tap the Settings cog
  3. Tap Auto Archive
  4. Toggle on Custom for This Podcast
  • Archive Played Episodes: choose whether episodes should be archived as soon as they are finished playing, at some point later, or never
  • Archive Inactive Episodes: episodes are considered inactive when you haven’t played, downloaded or unarchived within a given period of time
  • Episode Limit: setting a limit will only keep the most recent 1, 2, 5, or 10 episodes, while archiving any that are older

To show or hide episodes you’ve archived of a particular podcast tap Show archived / Hide archived on that podcast’s page.

This is also available as a global setting at Profile > settings cog > General > Show archived.

To unarchive episodes

  • Swipe right to left over the episode in an episode list
  • Or tap the episode, then tap Unarchive
  • Or if all episodes of a podcast are archived, tap the vertical ellipsis and tap Unarchive All

Tip:

Archiving an episode doesn’t change the playing status, so you won’t lose where you’re up to, and you’ll also always know whether you’ve played something or not.


Archiving Episodes

To manually archive individual episodes

  • Swipe the episode row from right to left on in an episode list or filter.
  • Or tap on an episode on any page, and tap  Archive on the episode card. Please note: if you have Play Up Next On Tap enabled, you will need to long press an episode in Up Next to access its episode card.
  • In the Now Playing screen tap Archive in the player toolbar. By default, Archive is in the toolbar’s three dot menu, but you can customise the toolbar so that Archive is one of your quick access shortcuts if you wish.

To manually archive episodes in bulk

  • On a podcast’s page, tap the  three dot menu > tap Archive All to archive all episodes of that podcast.
  • Enter multi-select mode on a podcast’s page, in a filter, or the Downloads list (long press an episode row or tap the  three dot menu > Select Episodes) > tap Archive in the multi-select action bar. By default, Archive is in the action bar’s  three dot menu, but you can customise the action bar so that Archive is one of your shortcuts.
  • In the Up Next screen tap Select > select episodes manually or tap Select All > three dot menu > Archive.

To auto archive episodes for all podcast subscriptions

You can add it to Pocket Casts by pasting it in here: https://pocketcasts.com/submit. Please ensure you select Private so that it won’t be shared with anyone, or appear in search for anyone else.

This will give you back a short URL that you can use to access the feed in our iOS and Android apps and Web . Next step is take this short URL and paste it into the podcast search bar within the app itself (available in either Podcast or Discover tabs).
